What should I do after being a passenger in an auto accident?

As a passenger you are almost never at fault, and you may have claims against either driver's insurance — or both. Get medical attention first, document everything, and speak to an attorney before giving any recorded statement to an insurer.

A car hit me from behind and now the driver won't cooperate. What can I do?

Florida is a no-fault state, so your own PIP coverage pays first regardless of the other driver's cooperation. From there, an attorney can identify their insurer and pursue the at-fault driver for damages beyond what PIP covers.

The insurance company wants to settle for less than my claim is worth. Can I get more?

You are not required to accept the first offer — and it is usually far below what a claim is actually worth. Once the full extent of your injuries and treatment is known, we negotiate from evidence, not from the insurer's opening number.
